EMPLOYER – WHAT WILL BE EXPECTED OF YOU

Apprentices must be registered with an appropriate state or territory training authority. You should contact the Australian Apprenticeship Support Network (AASN) to ensure the training contract is signed by the parties and provided to the Apprenticeship Network Provider (ANP) within the relevant State timeframe. Timeframes can vary between States, so we recommend you contact your AASN immediately after you agree to take on the apprentice to ensure you are aware of your obligations. An employer can only pay an employee apprentice pay rates if they have a formal training contract with the employee.

A probationary period generally applies when the apprentice starts with you, usually for the first three months. The probationary period will be specified in the training contract. The training contract can generally be cancelled by either you or the apprentice during the probationary period.

Apprentices may be employed on a full-time or part-time basis. Apprentices cannot be employed as casuals or independent contractors. Wages for apprentices depend on a range of factors including their age and the type of qualification. You must ensure the apprentice is paid the correct wage for the work they are performing. This includes any applicable penalties, loadings or allowances. This will generally be dependent on the industrial instrument that applies to the apprentice’s employment, for example, a modern award (such as the Building and Construction General On-site Award 2010) or a registered agreement.

The Fair Work Ombudsman (13 13 94), the AASN and your ANP will be able to assist you to understand these requirements and your obligations when taking on an apprentice. If you are a member of an employer association, they may also be able to provide you with assistance.

All employers that engage workers under an oral or written contract of service or apprenticeship, must have workers’ compensation insurance that covers all workers. Please note your workers’ compensation arrangements will apply to the employment.

ADDITIONAL EXPECTATIONS:

  • Provide and maintain a physically and psychologically safe work environment
  • induct the apprentice, and provide clear safety information, training and supervision including:
    • Emergency management and first aid arrangements
    • How to report a hazard, incident or near miss
    • What to do if you are injured
    • Training specific to the tasks the apprentice will be performing
  • Give clear lawful and reasonable instructions
  • Understand the training requirements and obligations
  • Know when the apprentice is due for TAFE/RTO Training
  • Develop a relationship with the TAFE/RTO
  • Assist apprentice with travel (if required) and pay any applicable travel allowances
  • Comply with the relevant industrial instrument including, but not limited to, pay and conditions of employment
  • Comply with pay slip and record-keeping obligations including details of superannuation contributions
  • Be a role model and a leader
  • Encourage completion of the apprenticeship
